By accessing or using Ephemeral ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms contain limitations of liability and a binding arbitration clause. Please read them carefully before using the Service.
Service Description
Ephemeral provides a secure, temporary secret sharing service that allows users to:
- Create encrypted, self-destructing secrets
- Share secrets via unique, one-time links
- Optionally protect secrets with passwords
- Set custom expiration times (TTL) for secrets
The Service is designed to be ephemeral by nature. Secrets are automatically deleted after being viewed once or when their TTL expires. We do not maintain backups of secret content.
Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. Acceptable uses include:
- Sharing passwords, API keys, or credentials securely
- Sending sensitive business information
- Sharing personal information that requires confidentiality
- Any legal communication that benefits from encryption and automatic deletion
Prohibited Content
You may NOT use the Service to create, store, or transmit:
- Child sexual abuse material (CSAM) or any content exploiting minors
- Content that promotes terrorism or violent extremism
- Malware, viruses, or malicious code
- Stolen data, including personal information obtained without consent
- Content that infringes intellectual property rights
- Threats, harassment, or content promoting violence
- Fraudulent schemes or phishing content
- Any content illegal under applicable law
We maintain a zero-tolerance policy for CSAM and terrorism-related content. Such content will be reported to appropriate authorities, and users may be subject to criminal prosecution.
Your Responsibilities
When using the Service, you are responsible for:
- Link Security: Keeping your secret links confidential and sharing them only with intended recipients.
- Password Management: If you use password protection, choosing a strong password and communicating it securely.
- Legal Compliance: Ensuring your use of the Service complies with all applicable laws and regulations.
- Content Ownership: Having the right to share any content you upload to the Service.
Intellectual Property
Our Property
The Service, including its design, code, logos, and documentation, is owned by Ephemeral and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.
Your Content
You retain all rights to the content you upload. By using the Service, you grant us a limited license to encrypt, store, and transmit your content solely for the purpose of providing the Service. This license terminates when your secret is deleted.
Service Availability
We strive to provide reliable service, but we do not guarantee:
- 100% uptime or availability
- That the Service will be error-free or uninterrupted
- That secrets will be delivered to recipients
- Preservation of secrets beyond their TTL
The Service is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.
Maintenance
We may perform scheduled or emergency maintenance that temporarily affects service availability.
Updates
We may update the Service at any time. Updates may add, modify, or remove features.
Discontinuation
We may discontinue the Service with reasonable notice. Active secrets will be honored until expiration.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Ephemeral and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total liability for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim (if any).
- We are not liable for any loss of data, including secrets that are deleted, expire, or become inaccessible for any reason.
Some jurisdictions do not allow limitations on liability. In such cases, the limitations above may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless Ephemeral and its operators, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you create or share through the Service
Termination
We may terminate or suspend your access to the Service immediately, without prior notice, if:
- You violate these Terms
- You use the Service for prohibited purposes
- We are required to do so by law
- We discontinue the Service
Upon termination, your right to use the Service will immediately cease. Any secrets you have created may be deleted without notice.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the European Union and the jurisdiction where Ephemeral operates, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date.
Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.
